SHORT-TERM RENTAL AGREEMENT
SHORT-TERM RENTAL AGREEMENT
THE PARTIES.
This Short-Term Rental Agreement (“Agreement”) or (“Reservation”) is made on the date of the Guest’s reservation between the following:
GUEST: Guest’s name as defined in their booking confirmation or reservation and their invited, registered guests hereafter collectively known as “Guest,” or, “Releasor,” “I,” or “me.”
HOST: Little Raccoon Key, hereafter known as “Host” or “Little Raccoon Key.”
THE PREMISES.
The Host agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Host:
Address: 1 Harbor Rd Suite #1, Jekyll Island, GA 31527, United States.
Hereinafter known as the “Premises.”
LEASE TERM.
The Guest shall be allowed to occupy the Premises starting on the Guest’s check-in date and ending on the Guest’s check-out date as defined in the Guest’s booking confirmation or reservation (“Lease Term”). The Guest agrees to abide by the terms, conditions, and rules of the Host (the “Terms”).
OCCUPANTS.
The total number of individuals staying on the Premises during the Lease Term shall be limited to the number of guests selected at booking. Only registered guests are permitted on the property. The Guest does not have the right to sublet the Premises.
If more than the authorized number of guests are found on the Premises, this Agreement will be subject to termination by the Host without refund.
FEES.
The Guest shall pay to the Host the full amount as detailed during the booking process. Guest authorizes Host to charge the payment method on file for the full amount inclusive of any and all taxes and fees at the time of booking. In addition, Guest authorizes Host to place a pre-authorization hold on the payment method on file prior to Guest’s arrival.
Host may retain the details of any payment method on file by Guest to charge and as a security for the faithful performance of the Guest under the terms of this Agreement. Host may charge any credit card provided by Guest for any expenses, including but not limited to incidentals, damages, or other fees incurred by Guest or discovered thereafter.
DAMAGES AND/OR REMOVAL OF PROPERTY.
Host reserves the right to charge Guest the cost of replacing any items that are removed from the Premises by them without consent or to rectify damage caused by the deliberate, negligent, or reckless act of the Guest. The charge will be the full replacement amount of the missing item, including any additional charges incurred, regardless of when this may come to light.
CANCELLATIONS.
If a Guest cancels up to 30 days before check-in (original date of arrival), a refund will be given. After that, Guest may cancel up to 14 days before check-in and receive a 50% refund on the nightly rate for the stay. All cancellations are subject to any processing fees incurred by Host.
Standard credit card authorization policies vary from bank to bank and can take up to 14 business days to release.
To notify Host of cancellation, Guest must notify Host in writing via email to hello@littleraccoonkey.com.
Host provides an outdoor experience to Guest in a natural environment within tent-like structures or cabins on the Premises. Guest acknowledges and accepts that they are booking a stay in a natural outdoor environment and assumes responsibility for preparing for this environment and its elements, including but not limited to inclement weather, extreme temperatures, insects, pests, wildlife, or loss of power or utilities.
Weather, flight changes, delays, cancellations, or illness affecting travel are outside the control of Host. Guest’s reservation is made rain or shine, and Host will not provide refunds for any of the above reasons.
Host recommends that Guests obtain trip insurance through an outside provider.
Rescheduling: Requests must be submitted at least 30 days prior to the original arrival date. If new dates have higher room rates, Guest agrees to cover any additional cost.
If a stay is rescheduled, the new reservation will no longer be cancellable or refundable.
PETS.
Host allows up to two well-behaved dogs at an additional fee of $100 per dog. Dogs must be attended at all times. If the Guest is found to have pets on the Premises, Host may charge the Guest’s payment method on file for the applicable fee.
Pet fees are not applicable to Service Animals as defined by Georgia Law and the ADA.
Guest warrants that their pets will not pose a threat or danger to other guests or occupants. Pets must be maintained in a manner that does not disrupt the peaceful enjoyment of others. Improper or aggressive behavior by pets shall be deemed a breach of this Agreement and may result in the pet’s removal from the Premises.
Guest acknowledges that they are responsible for any damages or nuisances caused by their pets and that pets must not be left unattended within accommodations and must be on a controlled leash when outside.
SMOKING POLICY.
Smoking of any kind within the accommodations is prohibited. A sanitization fee of $500 will be charged if smoking occurs within a guest room.
NON-ARRIVAL.
Should Guest fail to arrive on the scheduled day of reservation, the Guest room will be held until the following day in case of unforeseeable delays. If the Guest does not arrive by the next day, the Reservation will be canceled and the total accommodation charge will be applied to the Guest’s payment method on file.
After check-in, should the Guest shorten their stay, full payment will be forfeited.
REGISTRATION.
Guest agrees to complete a registration form, sign any required documents, and provide a valid form of identification prior to arrival.

INSPECTION.
The Host has the right to inspect the Premises with prior notice in accordance with State law. Should the Guest violate any of the terms of this Agreement, the rental period may be terminated immediately. The Guest waives all rights to process if they fail to vacate the Premises upon termination. Guest shall vacate the Premises at the expiration time and date of this Agreement.
MAINTENANCE AND REPAIRS.
Guest shall maintain the Premises in good, clean condition and use the Premises only in a careful and lawful manner. Guest shall leave the Premises in a ready-to-rent condition at the end of this Agreement, defined by the Host as being immediately habitable by the next Guest.
Guest shall pay for maintenance and repairs if the Premises are left in lesser condition. Host may deduct such costs from the payment method on file.
TRASH.
Guest shall dispose of all waste material generated during the Lease Term under the direction of the Host.
CHILDREN.
No unaccompanied minors are permitted on the property. Guests must be over the age of 21 to book a reservation.
HOST’S LIABILITY.
Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises, regardless of cause.
Guest expressly acknowledges that any insurance maintained by Host does not cover Guest’s personal property and that Guest should obtain their own insurance if desired.
ATTORNEY’S FEES.
Guest agrees to pay all reasonable costs, attorney’s fees, and expenses incurred by Host in enforcing this Agreement.
USE OF PREMISES.
Guest shall use the Premises for residential purposes only. Guest is not authorized to sell products, provide services, or conduct commercial activities including events without prior written consent of Host.
SAFETY.
Host reserves the right to disallow use of fires in unsafe conditions. Guest must never leave a fire unattended and must extinguish it completely after use.
Guest may be liable for any damages caused by negligent use of fire.
ILLEGAL ACTIVITY.
Guest shall use the Premises for legal purposes only. Any illegal activity, including but not limited to underage drinking, illicit drug use, or abuse of persons, will result in immediate termination of this Agreement without refund.
POSSESSIONS.
Any personal items or possessions left on the Premises are not the responsibility of the Host. Host may make reasonable effort to return items to the Guest. Unclaimed items after two (2) weeks may be kept or disposed of by Host.
GOVERNING LAW.
This Agreement shall be governed by and subject to the laws of the State of Georgia.
Guest agrees that if they are inviting other guests, or booking on behalf of a group, they acknowledge and accept all terms on behalf of all parties and represent they have the authority to bind them to this Agreement.
Guest agrees, acknowledges, accepts, and will abide by the policies, terms of service, and other conditions listed or summarized on Host’s website or provided in writing.

ELECTRONIC SIGNATURES.
Guest agrees that electronic signatures, whether digital or encrypted, are intended to authenticate this writing and to have the same force and effect as manual signatures.
The term “electronic signature” means any electronic sound, symbol, or process attached to or logically associated with a record and executed by a party with the intent to sign, including but not limited to clicking an acceptance box or electronically signing during booking or registration.
CONSENT.
Guest acknowledges they have read, understood, and accept the terms of this Agreement by clicking an acceptance box and/or electronically signing when booking, registering, or otherwise as required.
